Website Privacy Policy

Our commitment to privacy

Visitors that are residents of California should also refer to our California Website Privacy Policy supplement, which is available on this page. Visitors that are residents of the United Kingdom, the European Union or the European Economic Area should also refer to our EU Website Privacy Policy, which is available on this page. To the extent any supplement conflicts with this Privacy Policy in its treatment of job candidates, business contacts, advisors or subject matter experts, this Privacy Policy governs. Individuals located in Canada should refer to the "Canadian Applicants and Business Contacts" section below.

Your privacy is important to American Pacific Group, L.P. and its affiliates (together, "American Pacific Group," "our," "us" or "we"). To better protect your privacy, we are providing information explaining our information practices, both with respect to visitors to this website and with respect to individuals with whom we interact in the regular course of our business, including job candidates and other prospective business contacts. This Privacy Policy (this "Privacy Policy") describes how we gather and use such information. Please read this Privacy Policy carefully. This Privacy Policy constitutes a legally binding agreement between American Pacific Group and you. By entering and using this website, or by submitting information to us via any means of communication in connection with a job application, recruitment process, or other business dealings, you acknowledge your acceptance of, and agree to be bound by, this Privacy Policy, our Terms of Use (as applicable) and all additional terms incorporated by reference herein. If you do not agree to this Privacy Policy, including any of the terms or conditions contained herein, please do not access or otherwise use this website or submit information to us via any means of communication.

The information we collect and how we use it

We may collect various types of information from users of this website, as well as from individuals we interact with in the regular course of business — including recruitment and hiring, vendor and business partner relationships, and other professional dealings. This information may be collected through this website, directly from you (for example, by email, mail, phone, or in person), or from third parties and other sources (for example, job boards, recruiting or applicant-tracking platforms, background-check providers, professional references, people who refer you to us, and publicly available or commercial sources such as professional networking sites, company websites, industry publications and conference materials, and expert networks).

Website usage information. Knowing how users use our website – tracking their movement through this website – helps us improve website design and usefulness. As a result, American Pacific Group's server collects general data pertaining to users, including the length of time spent on this website, the pages accessed while visiting the website and Internet Protocol ("IP") addresses. Some of this information, including IP addresses and cookie identifiers, is treated as personal information under applicable privacy laws. American Pacific Group does not, however, collect contact details such as names, home addresses or e-mail addresses from general users of this website, unless a user submits such information to us via our "Contact" page or otherwise provides it to us as described below.

Business, recruitment and professional contact information. In the regular course of our business, we may collect personal information about job candidates and applicants, such as names, contact information, resumes and cover letters, employment and education history, professional references, and other information you choose to provide as part of a job application or recruitment process. We may also collect similar categories of personal information about other business and professional contacts, such as executives, operating advisors, industry specialists and subject matter experts, board candidates, consultants, vendors, intermediaries, referral sources and prospective business partners. For these contacts we typically collect names, business contact details, employment history, areas of expertise, and information about our interactions with them. We use this information to evaluate candidates for employment, administer the recruitment and hiring process, communicate with applicants and business contacts, maintain our contact database as described below, comply with legal and recordkeeping obligations, and for other related business purposes. Where we conduct background checks or collect information such as date of birth, government identification numbers or work authorization status, we do so only where permitted by applicable law and only for the purposes described in this Privacy Policy.

To the extent that you provide us with any personally identifiable information — whether through this website, in connection with a job application, or otherwise in the regular course of business — we may use such information for American Pacific Group's business purposes, but we will not disclose personal information about you except as described in this Privacy Policy. This includes disclosure to our service providers (for example, background-check, applicant-tracking and customer-relationship-management vendors assisting us), to companies in which we invest and to co-investors, lenders and advisors as described in the "Business contacts, advisors and subject matter experts" section below, and as permitted or required by applicable law or regulation. We do not sell your personal information — including candidate and applicant information — to third parties. Where applicable law requires your consent, then in providing personal information to American Pacific Group you consent to American Pacific Group's use of that information for the purposes described in this Privacy Policy, and you may withdraw that consent at any time. Where we are permitted to do so, including in the European Economic Area and the United Kingdom, we may instead rely on our legitimate interests in operating our business, identifying and evaluating investment opportunities, and maintaining professional relationships, or on steps necessary to enter into or perform a contract with you. We may also share your personal information with applicable third parties in the event of a reorganization, merger, sale, acquisition, assignment, bankruptcy proceeding or other disposition of all or a portion of our business, assets or shares. We maintain administrative, technical and physical safeguards designed to protect personal information against unauthorized access, use or disclosure, and we will notify affected individuals and regulators of a security incident involving personal information where required by applicable law. American Pacific Group is located in the United States, and personal information we collect is transferred to, stored and processed in the United States. Where we transfer personal information from the European Economic Area, the United Kingdom or Canada, we do so via a transfer mechanism as permitted by applicable law. Unfortunately, the transmission of information and data via the internet is not completely secure. Although we make an effort to protect your personal information, we cannot guarantee the security of any information or data transmitted to or through our website or otherwise provided to us; any such transmission is at your sole risk.

Job candidates and applicants

If you submit a resume, application, or other information to us in connection with a job opportunity — whether directly, through a recruiter, or through a job board or applicant-tracking platform — we collect and use that information for purposes related to evaluating your candidacy, administering our recruitment and hiring processes, and complying with applicable recordkeeping and legal obligations. We may also retain your information in our contact database after a particular hiring process concludes, so that we may consider you for future opportunities at American Pacific Group and at companies in which American Pacific Group affiliates invest or may invest, and we may share your professional details with those companies and with co-investors, lenders and advisors working with us. We retain candidate information for as long as you remain an active professional contact of the firm and thereafter for as long as reasonably necessary for these purposes and in accordance with applicable law, and we review our records periodically to remove information we no longer need. You may ask us to remove you from our contact database, or to stop contacting you, at any time using the contact details below, and we will do so promptly. We do not sell candidate personal information.

Business contacts, advisors and subject matter experts

In the ordinary course of our business, we build and maintain a database of professional contacts. This includes executives, operating advisors, industry specialists and subject matter experts, board candidates, consultants, vendors, intermediaries, referral sources and other business contacts. We collect this information directly from you, from people who refer you to us, and from publicly available and commercial sources such as professional networking sites, company websites, industry publications and conference materials, and expert networks.

We use this information to identify and evaluate investment opportunities; to seek market insight, commercial diligence input and expert commentary; to identify candidates for executive, advisory and board roles at American Pacific Group and at companies in which we invest; to contact you about opportunities and matters we believe may be of interest to you; and to manage our relationship with you. This may involve sharing your professional details with companies in which we invest and with co-investors, lenders and advisors working with us on a transaction. We do not sell this information.

We retain this information for as long as you remain an active professional contact and thereafter for as long as reasonably necessary for the purposes described above, and we review our records periodically to remove information we no longer need. You may ask us at any time to remove you from our contact database, or to stop contacting you, using the contact details below, and we will do so promptly.

Where we obtain your information from a source other than you, we will identify that source and the purposes described above at or around the time we first contact you, or otherwise within the period required by applicable law. If you are located in the European Economic Area or the United Kingdom, we generally rely on our legitimate interests in identifying investment opportunities, obtaining professional expertise and maintaining professional relationships as the legal basis for this processing, and you may object to that processing at any time.

Canadian applicants and business contacts

If you are located in Canada, the personal information you provide to us as a job candidate, applicant, or other business contact is collected, used, and disclosed in accordance with applicable Canadian privacy law, including the federal Personal Information Protection and Electronic Documents Act ("PIPEDA") and any applicable provincial private-sector privacy legislation. Consistent with those laws, we will only collect, use, and disclose your personal information for purposes that are reasonable in the circumstances and that we identify at or before the time of collection — principally, evaluating your candidacy, administering our recruitment and hiring processes, and maintaining our contact database of candidates, business contacts, advisors and subject matter experts as described above — and, where required, only with your consent. As described above, we do not sell candidate or applicant personal information. You have the right to access the personal information we hold about you, to request correction of inaccurate information, and to withdraw consent to our continued collection, use, or disclosure of your personal information, subject to legal or contractual restrictions and reasonable notice. You may also ask us at any time to remove you from our contact database or to stop contacting you. To exercise any of these rights, please us at privacynotice@americanpacificgroup.com.

We do not knowingly encourage or solicit visitors to this website who are under the age of 18 or knowingly collect personal information from anyone under the age of 18. If we learn we have collected or received personal information from an individual under the age of 18, we will delete that information.

Your choices and rights

Depending on where you live, you may have the right to access the personal information we hold about you, to request that we correct or delete it, to receive a copy of it in a portable format, to object to or ask us to restrict certain processing, to withdraw any consent you have given, and to ask us to remove you from our contact database or stop contacting you. We will not discriminate or retaliate against you for exercising these rights. We may need to verify your identity before acting on a request, and an authorized agent may submit a request on your behalf where applicable law permits. Notification of changes

We reserve the right to amend this Privacy Policy from time to time and for any reason, in our sole discretion, by updating this Privacy Policy. Accordingly, users are strongly encouraged to review this Privacy Policy regularly. If we decide to change this Privacy Policy, we will post those changes so our users are always aware of what information we collect, how we use it and under what circumstances, if any, we disclose it. If at any point we decide to collect personal information or use any collected information in a manner different from that stated at the time it was collected, we will notify users by posting changes on this page. If we intend to use personal information we have already collected in a materially different manner, we will provide notice and, where required by applicable law, obtain your consent before doing so. Your continued access or use of this website, or your continued participation in a recruitment process or professional relationship with us, following the posting of changes to this Privacy Policy constitutes your acceptance of, and agreement to be bound by, such revisions, changes and/or amendments. If you object to any of the changes to this Privacy Policy, please stop accessing this website. Please check this page frequently and review any changes to this Privacy Policy carefully so you are aware of any changes, as they are binding on you.

This Privacy Policy is governed by the laws of the State of California, without regard to its conflict of laws principles, except where applicable data protection law provides otherwise. If any provision of this Privacy Policy is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
